The Committee discussed for the I reading the Draft Criminal Procedure Code envisaging the revision of the judgment in the light of the newly revealed circumstances.
As noted in the amendment, the judgment shall be revised due to the newly revealed circumstance in the event of the availability of the decision of the UN Committee on the Rights of Persons with Disabilities that, in re, determines the breach of the Committee Convention and the reviewable judgment is based on the hereof breach.
A similar approach is applied under the legislation of Georgia in the event when it delves into the violation of the rights established by the European Court of Human Rights and the UN Human Rights Committee, the Committee on the Elimination of Discrimination against Women, the Committee on the Rights of the Child, the Committee against Torture or the Committee on the Elimination of Racial Discrimination.
The respective amendments are to be introduced to the Civil Procedure Code, and the Administrative Procedure Code.
